TWorld Terms and Conditions

  1. These TWorld Terms and Conditions apply to your use of Yahoo! TWorld ("Y! TWorld") with Telecom ( or "us" or "we")
  2. These terms apply in addition to the Xtra Customer Terms and the Xtra Service Terms and the Yahoo!New Zealand Terms of Service.

General

  1. Unless otherwise stated, you will be charged your standard data charges for all mobile internet browsing, downloading and streaming. Each time you visit or refresh a page you are incurring data charges. Telecom customers are charged according to their chosen data extra or mobile broadband plan. If you have not opted for one of these, then you pay casual data rate charges. Casual data charges on the XT Network are $1 per day for up to 10MB, only charged on the days you use data. Any additional data over 10MB in a day is $1 per MB. Telecom's CDMA customers are subject to different data charges, including different casual data charges.   2. When you see the word "UNMETERED" next to a link or at the top of the page then viewing that specific page will not count towards your XT Mobile data usage while you are in New Zealand. "Unmetered" access does not apply when you are roaming outside of New Zealand, or if you are with another network provider.
  3. Telecom's Global Roaming charges apply for all data access, including "unmetered" pages, when you are outside of New Zealand.
  4. We may remove the "UNMETERED" status of a page at any time at our sole discretion.
  5. There may be additional charges for accessing, downloading or subscribing to content or services through Y! TWorld. e.g. when you purchase a ringtone or subscribe to a TWorld service like Mobile TV. We'll notify you on your mobile before content or subscription charges are incurred. If you subscribe to receive Info Alerts, these are charged at $0.20 per text sent.
  6. The price of content or services that are offered by Telecom are current at the time you order these. They may change at any time without notice, and you should check the price of all products and services at the time you place an order for them.
  7. There may be some restrictions on the content you can access or use which may depend on your handset and coverage area, whether you are a prepaid or postpaid customer, or your age. If a prepaid account reaches a zero balance while connected, the data session will be disconnected by the network immediately.
  8. Additional terms and conditions may apply to your use of content. We may suspend, withdraw or cancel, upgrade or degrade any service, experience or content on Y! TWorld at any time. There is no guarantee of the ongoing availability of services.
  9. We will take all reasonable care when we provide you TWorld content and services however we do not provide a warranty or guarantee that any of the content or services supplied by us will be fault free, or continuous. We try to keep our Y! TWorld content and services as up to date and accurate as possible, however we cannot guarantee that the information and services are accurate and up to date at all times.
  10. To the extent permitted by law, we are not responsible for any faults, or any loss or damage associated with your use (either directly or indirectly) of the services provided by Y! TWorld. Telecom does not accept any liability for any loss or damage which may directly or indirectly result from any information contained on Y! TWorld, or on any third party sites.
  11. Some downloadable content, including games and music, may not be transferrable between mobile handsets, or mobile accounts. Some handsets may show a security warning when installing downloadable content.

Third parties content

  1. Telecom has no responsibility for any additional charges which may apply on third party sites, and your standard data charges will occur on all third party sites you access (e.g. by clicking on a third party weblink in search results, browsing sites from the Today, My Favourites or All Sites landing pages or when you type a URL address for a third party site into your browser, or for use as one of your bookmarks)
  2. Some content provided is licensed to Telecom by 3rd parties and sub-licensed to you. Please ensure that you have read all the terms and conditions relevant to the content that you are purchasing. To the extent permitted by law, Telecom is not responsible for 3rd party content, including Yahoo!New Zealand information and does not promise its accuracy, suitability or quality. Telecom does not accept any liability for any loss or damage which may directly or indirectly result from any information contained on Y! TWorld, or on any third party sites.

These terms

  1. Changes or updates to the content and information on Y! TWorld, including these Terms and Conditions, may occur at any time without prior notice. Please check the "Charges & T&C" link on your Y! TWorld portal or visit these full terms frequently as you are bound to accept the current terms and conditions each time you access this service.
  2. If there is any inconsistency between these terms and conditions any additional Telecom terms and conditions then these terms and conditions take precedence.
  3. Telecom reserves the right to suspend, withdraw or restrict your services for any reason at any time, including if you are in breach of these terms.

Privacy

  1. The information received through your use of Yahoo!New Zealand content is subject to the Yahoo!New Zealand Mobile Privacy Policy. The information that we receive through your use of TWorld and Telecom branded pages, content, and services may be held and used by Telecom and is subject to the Xtra Customer terms [link to new Xtra customer terms page in V7] and Our Privacy Policy.

Use of the site

  1. You must not use this site or any information contained on this site in breach of any law or of any of the terms and conditions that apply. And you must not use this site in a manner that will impinge on the rights of any other person, or their enjoyment of using this site, or disrupt this site or any other Telecom website. This website is governed by, and is to be interpreted in accordance with, the laws of New Zealand.

Intellectual Property

  1. Telecom and/or Yahoo!New Zealand owns all copyright and all other intellectual property rights in this site, unless specifically identified as belonging to a third party like Yahoo!. Everything on this site is copyrighted unless otherwise noted. Telecom welcomes the use of this site for your non-commercial use only provided that you do not remove any copyright, trademark and other proprietary notices contained in the content. You may not copy or display for redistribution to third parties or for commercial purposes, any portion of this site without Telecom's express permission.

Acceptance of order by Telecom

  1. Any time you order content, or any other product or service from TWorld, you are making an offer to Telecom to purchase that content, product or service. Telecom may accept or decline that offer in its sole and absolute discretion. Notwithstanding that Telecom may process payment for an order, an order will not be considered accepted until Telecom dispatches the product or supplies the service. The Consumer Guarantees Act 1993 applies to your purchases through Y! TWorld, unless you are using it for the purposes of a Business.

Security

  1. . Purchasing any content, product or service through mobile internet is not guaranteed to be secure, and is at your own risk. Please be aware of this especially when making purchases through any third party site, as Telecom accepts no liability for any losses or damage. But if you have any concerns about any products and services purchased through TWorld then please immediately contact Telecom on *123 for consumers or 126 for business enquiries.
