Your Telecom Terms and Conditions

Terms and Conditions for customers

  1. Terms: Please read these Terms carefully, as they explain how the Your Telecom service works. Telecom may be referred to in these Terms as 'we' or 'us'. These Terms, together with Telecom's Standard Terms for Residential Customers and Standard Terms for Business Customers (as applicable) form part of the contract between you as a customer and us as the provider of the Your Telecom service. By registering to use the Your Telecom service you acknowledge that you have read and understood these Terms and agree to be bound by them.
  2. You also acknowledge you are the Telecom account holder or authorised by the Telecom account holder to register for and access the Your Telecom service.

Notice of changes and acceptance

  1. We may amend these Your Telecom Terms, or the terms of any other online service supplied to you by Telecom and accessed via Your Telecom ("Online Service"), and introduce new fees or change existing fees for your use of those services, by giving you at least one month's notice before any changes take effect. We'll notify you of any changes by:
    1. displaying the change on this website (you will normally be advised there has been a change when you next sign-in to use the service); or
    2. emailing to your last known email address; or
    3. advertisements in other widely circulated or viewed, media.
    If we change any Terms, your continued use of the service concerned indicates acceptance of the changes.

How the Your Telecom service works

  1. Authorisation and access: you will need to complete all details on the online application form and Submit it to us. You will then be able to view you Telecom account information online.

Security

  1. Sign-in name and password: to use the Your Telecom service you will need to choose a sign-in name and a password on your application form. Your sign-in name and password should not be something obvious, or easily guessed, such as birth dates or street numbers.
  2. Security of sign-in name and password: you are responsible for the safekeeping of your sign-in name and password and must take all reasonable steps to prevent their disclosure to any other person. You must not, for example, disclose your sign-in name and/or password to your family and friends, or to anyone who claims to have a right to this information, including our employees. Your sign-in name and password should be committed to your memory, and under no circumstances should you keep a written or electronic record of your sign-in name and password.
  3. Reliance on Password: you understand and agree that we are entitled to rely on the authenticity of your sign-in name and password being supplied to access any service supplied by us, or to give us instructions on your behalf. Where the correct sign-in name and password have been entered, we may act on any instructions given without further enquiry.
  4. Changing your password: we will arrange for you to select a new sign-in name and password and to change this detail in our system if you tell us as soon as you become aware that your sign-in name and/or password may be known to another person and/or there has been unauthorised access to your Telecom customer file.

Your account information

  1. Account summary: when you access your customer file you will see: your customer name, address, account number(s), any overdue charges, current charges, total due charges, details of last three payments received, bill date, bill period, total bill amount and sub-totals for categories billed, a general description of the total billed product or service, any unbilled calls for all your accounts, information on numbers you've called, details of your Xtra Broadband usage and your current Telecom mobile included minute balance and detail (if applicable).

Liability and Exclusions

  1. No liability: subject to complying with these Terms, you will not be liable for loss caused by:
    1. fraudulent or negligent conduct by employees or agents of Telecom; or
    2. faults in the Your Telecom service, unless such faults are obvious or you have been advised not to use the Your Telecom service temporarily, by message or notice on display; or
    3. any other unauthorised transactions where it is clear that you could not have contributed to the loss, provided that you can prove such impossibility to our satisfaction.
  1. Fraud and contributing to loss: you are liable for all losses if you have acted fraudulently at any time, either alone or together with any other person, in using the Your Telecom service. You are also liable for losses where any act or omission of yours has contributed to causing those losses.
  2. Exclusions: except as expressly set out in these Terms, we exclude all warranties which may be implied into these Terms by law, to the extent permitted by law.
  3. Our liability to you: these Terms contain certain exclusions of our liability to you. The exclusions and limitations on Telecom's liability that are set out in Telecom's Standard Terms for Residential Customers and Standard Terms for Business Customers also apply and you should read these carefully.

Other Terms

  1. Availability of service: we have made all reasonable efforts to ensure that the Your Telecom service, and any other Online Service will be properly provided to you. However, we do not guarantee that these services will be error-free, uninterrupted, continuously available, or free from viruses or malicious programmes.
  2. Consumer Guarantees Act: please note that this Act provides you with certain statutory rights and remedies in relation to consumer goods and services. However, if you are using the Your Telecom service, or any other Online Service, for the purpose of a business, you agree that the Consumer Guarantees Act 1993 shall not apply.
  3. Links to other sites: for your convenience, the Your Telecom service and other Online Services may provide links to other websites, over which we have no control. You agree that we have no responsibility for the availability of those sites and that we have no liability for and do not endorse any content, advertising, products or services available from such sites.
  4. Privacy: in addition to providing Telecom services to you, you agree that we may use your information for the purpose of providing you with promotional material on our other services and special offers by email or other promotional means.
  5. Notices: all notices to Telecom should be sent to YourTelecomSupport@telecom.co.nz.
  6. Governing law: New Zealand law governs these Terms, and any other terms that apply to Online Services and the New Zealand courts shall have non-exclusive jurisdiction over any dispute arising.
